1. Introduction and Agreement

These Terms of Service ("Terms") constitute a binding legal agreement between you ("User" or "You") and Focus One ("Developer," "We," "Us," or "Our"), the provider of the Focus One mobile application (the "App").

By downloading, accessing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, including the dispute resolution provisions in Section 12, you must not use the App.

AGE REQUIREMENT: You must be at least 18 years old to purchase a subscription. If you are under 18, you may only use the free version of the App with the involvement of a parent or guardian.

2. Description of Service

Focus One is a productivity application designed to help users manage tasks using "single-tasking" principles. The App includes features such as:

Local task management and storage.
AI-powered "Brain Dump" prioritization and "Task Breakdown."
Focus timers and session tracking.

Service Modifications: We reserve the right to modify, suspend, or discontinue the App (or any part thereof) at any time with or without notice. You agree that we shall not be liable to you or to any third party for any modification, suspension, or discontinuance of the App.

Not Medical Advice: The App is a productivity tool only. It is not designed to diagnose, treat, or manage ADHD or any other medical condition. You should not rely on the App as a substitute for professional medical advice, diagnosis, or treatment.

3. Subscriptions and Payments

The App offers a "Pro" subscription that unlocks unlimited access to premium features.

3.1 Apple App Store Subscriptions

The following terms are required by Apple:

Automatic Renewal: Subscription automatically renews unless auto-renew is turned off at least 24 hours before the end of the current period.
Billing: Account will be charged for renewal within 24-hours prior to the end of the current period at the cost of the chosen package.
Management: Subscriptions may be managed and auto-renewal turned off in Account Settings after purchase.
Free Trials: Any unused portion of a free trial will be forfeited when purchasing a subscription.

3.2 Pricing and Refunds

Pricing: Prices are displayed in the App Store and may change. We will notify you of material price changes in advance where required by law.
Refunds: Subscriptions are managed directly by Apple. We do not have the ability to process refunds. You must contact Apple Support for any refund requests. Apple's refund policy applies.

4. Artificial Intelligence (AI) Features

The App utilizes third-party artificial intelligence services (specifically xAI) to provide features like "Brain Dump" and "Task Breakdown."

By using these features, you acknowledge and agree that:

Accuracy: AI-generated content is probabilistic and may be inaccurate, incomplete, or inappropriate. You should independently verify any advice or suggestions generated by the AI.
No Professional Advice: The App is for informational and productivity purposes only. AI suggestions are not professional, medical, legal, or financial advice.
Data Transmission: To function, your task text is transmitted to our AI provider. While we do not use your data to train models, you grant us a license to transmit this data solely for providing the service.
Service Availability: AI features depend on third-party services and may be unavailable, slow, or discontinued at any time without notice.

AI DISCLAIMER: WE MAKE NO WARRANTIES REGARDING THE ACCURACY, COMPLETENESS, RELIABILITY, OR SUITABILITY OF ANY CONTENT GENERATED BY AI FEATURES. YOU USE AI FEATURES ENTIRELY AT YOUR OWN RISK.

5. User Content and Privacy

5.1 Local Storage

Focus One is designed as a privacy-first, local-storage app. Your tasks, goals, and history are stored on your device. We do not access or sell your personal data.

5.2 License to Us

You retain ownership of all tasks and content you create in the App. However, by entering content into AI-powered features (e.g., Brain Dump), you grant us a worldwide, non-exclusive, royalty-free license to transmit and process that content solely for the purpose of providing the AI response to you. This license terminates when you delete the content or uninstall the App.

5.3 Privacy Policy

Your use of the App is also governed by our Privacy Policy. The Privacy Policy is incorporated into these Terms by reference.

6. Acceptable Use Policy

You agree not to use the App to:

Generate content that is illegal, harmful, threatening, abusive, harassing, defamatory, or promotes violence or discrimination.
Attempt to reverse engineer, decompile, disassemble, or extract the source code of the App.
Abuse AI Features: You expressly agree not to:
- Attempt to "jailbreak," "prompt inject," or otherwise manipulate the AI into ignoring its safety filters or instructions.
- Reverse engineer, extract, or attempt to discover the underlying system prompts, model weights, or instructions used by the AI.
- Use the AI features to generate content that violates the terms of our AI providers (including xAI).
- Use automated scripts, bots, or other programmatic methods to send excessive or abusive requests to the AI service.
- Resell, redistribute, or commercially exploit AI-generated outputs.
Bypass, circumvent, or manipulate the subscription billing mechanisms or "free tier" limitations.
Impersonate any person or entity, or falsely state or misrepresent your affiliation with a person or entity.
Use the App for any purpose that is unlawful under applicable law.

Consequences of Violation: We reserve the right to take any of the following actions, at our sole discretion, if we determine you have violated these Terms:

Issue a warning.
Temporarily or permanently suspend your access to the App.
Permanently ban your device from accessing the App.
Report your conduct to law enforcement authorities.

No Refunds for Termination: If your access is terminated due to a violation of these Terms, you are not entitled to any refund of subscription fees.

7. Intellectual Property

The App, including its original code, design, user interface, "Focus One" name, logo, and all associated visual elements, is the intellectual property of Focus One and is protected by international copyright, trademark, and other intellectual property laws.

You are granted a limited, personal, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial use only, subject to these Terms. This license does not include any right to:

Modify, adapt, or create derivative works of the App.
Use the App's content or design for commercial purposes.
Remove or alter any copyright, trademark, or other proprietary notices.

8. Warranties and Disclaimers

THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, WE EXPRESSLY DISCLAIM ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING BUT NOT LIMITED TO:

IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
WARRANTIES ARISING FROM COURSE OF DEALING, USAGE, OR TRADE PRACTICE.

WE DO NOT WARRANT THAT:

THE APP WILL FUNCTION UNINTERRUPTED, SECURE, OR ERROR-FREE.
ANY ERRORS, BUGS, OR DEFECTS WILL BE CORRECTED.
THE APP WILL MEET YOUR REQUIREMENTS OR EXPECTATIONS.
ANY AI-GENERATED CONTENT WILL BE ACCURATE, COMPLETE, OR RELIABLE.
THE APP WILL BE AVAILABLE AT ANY PARTICULAR TIME OR LOCATION.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL FOCUS ONE, ITS AFFILIATES, OR THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY:

INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES;
LOSS OF PROFITS, REVENUES, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES;
DAMAGES RESULTING FROM YOUR ACCESS TO, USE OF, OR INABILITY TO USE THE APP;
DAMAGES RESULTING FROM ANY CONDUCT OR CONTENT OF ANY THIRD PARTY;
DAMAGES RESULTING FROM ANY CONTENT OBTAINED FROM THE APP, INCLUDING AI-GENERATED CONTENT;
DAMAGES RESULTING FROM UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR DATA.

LIABILITY CAP: OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE APP SHALL NOT EXCEED THE GREATER OF: (A) THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) €50.

EU/EEA Consumer Rights: If you are a consumer in the European Union or European Economic Area, the above limitations do not affect any mandatory consumer protection rights you may have under applicable law. Our liability shall not be limited for damages caused by gross negligence or intentional misconduct, or for death or personal injury.

10. Indemnification

To the extent permitted by applicable law, you agree to defend, indemnify, and hold harmless Focus One from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or in any way connected with:

Your violation of these Terms.
Your misuse of the App.
Your violation of any rights of any third party.
Content you submit to AI features that infringes third-party rights.

11. Termination

11.1 Termination by You

You may stop using the App at any time by uninstalling it from your device. To cancel your subscription, you must do so through your Apple ID Account Settings.

11.2 Termination by Us

We may terminate or suspend your access to the App immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the App will immediately cease.

11.3 Effect of Termination

All provisions of these Terms which by their nature should survive termination shall survive, including but not limited to: intellectual property provisions, warranty disclaimers, limitation of liability, indemnification, and dispute resolution.

12. Governing Law and Dispute Resolution

12.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of Estonia, without regard to its conflict of law provisions.

12.2 Informal Resolution First

Before initiating any formal dispute proceedings, you agree to first contact us at support@focusone.io and attempt to resolve the dispute informally for at least 30 days.

12.3 Dispute Resolution for EU/EEA Residents

If you are a consumer residing in the European Union or European Economic Area:

You may bring a claim in the courts of your country of residence.
You may use the European Commission's Online Dispute Resolution (ODR) platform at https://ec.europa.eu/consumers/odr.
Nothing in these Terms affects your mandatory consumer protection rights under applicable law.

12.4 Dispute Resolution for Non-EU Residents

Any dispute arising from these Terms that cannot be resolved informally shall be resolved exclusively in the courts of Tallinn, Estonia.

12.5 Class Action Waiver

To the fullest extent permitted by applicable law, you agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action. You waive any right to participate in a class action lawsuit or class-wide arbitration against Focus One.

13. Changes to Terms

We may update these Terms from time to time. When we make changes:

Material Changes: We will notify you through the App or via email (if available) at least 30 days before the changes take effect.
Continued Use: Your continued use of the App after the effective date of the revised Terms constitutes your acceptance of the updated terms.
Disagreement: If you do not agree to the updated Terms, you must stop using the App and cancel your subscription.

14. General Provisions

14.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Focus One regarding the App and supersede all prior agreements.

14.2 Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.

14.3 Waiver

Our failure to enforce any right or provision of these Terms shall not be deemed a waiver of such right or provision.

14.4 Assignment

You may not assign or transfer these Terms or your rights hereunder without our prior written consent. We may assign these Terms without restriction.

14.5 No Third-Party Beneficiaries

These Terms do not confer any third-party beneficiary rights.
